Welcome to www.welyra.com (Site). The owner and operator of the Site is a limited liability company, or any of its current or future subsidiaries, affiliates, successors, or assignees collectively we,our,us or Welyra.
These User Terms & Conditions (“User Terms” or “Terms”) and all policies and additional terms (if applicable) posted on the Site set out the terms on which you, as a User, can access and use our Site, services and applications, including our mobile application, (collectively, the “Services”) for buying directly on the Site. These User Terms apply in addition to all our other terms (including Privacy Policy which is available on the Site and as amended from time to time, collectively the “Legal Documents”). By accessing, registering and/or continuing to use or access our Services, you are agreeing to be bound by these User Terms and the Legal Documents with immediate effect. References in these User Terms to “you” (or similar) are references to you as a legal entity.
Our Services
-We provide Services for you as a User to enable you to enjoy products as a registered user on the Site. Depending on the business model, our Services, provided by us or by affiliated companies or other third parties, may include, (1) warehousing, order management and fulfillment (e.g. communication with a user on his/her purchase, obtaining payment from a user and organizing delivery); (2) shipping the product from warehouse/premises to the user; (3) cash collection and processing of payments; and (4) call center and customer support.
-Modification of Service: Welyra reserves the right at any time and from time to time to modify or temporarily discontinue the Service (or any part thereof). You agree that Welyra shall not be liable to you or to any third party for any modification, suspension, or temporary discontinuance of the Service. Your continued use of the Site following such updates constitutes your acceptance of the revised Terms. If you do not agree to any of the terms in this Terms or to any future terms in a future revision of this Terms, do not use or access (or continue to access) the Site.
-When you order products and services from Welyra we treat this as an offer from you to purchase such products and services. We may refuse to accept such orders for any number of reasons – such as a failure to meet credit check criteria, unavailability of products or services, product or pricing errors.
-We reserve the right to determine the content, appearance, design, functionality and all other aspects of the Site and the Services (including the right to re-design, modify, remove and alter the content, appearance, design, functionality, and other aspects of the Site and the Service and any element, aspect, portion or feature thereof, from time to time), and to delay or suspend listing of, or to refuse to list, or to de-list, any or all products in our sole discretion. We may, in our sole discretion, withhold for investigation, refuse to process, restrict shipping destinations for, stop and/or cancel any of your transactions if we consider it necessary for legal purposes or to ensure compliance with these User Terms.
Welyra does not in any way guarantee the quality of any Goods or that any Goods complies with applicable laws and does not guarantee matching the list of Goods displayed on the Platform to what is actually provided to the Users. In addition, a Merchant may represent that goods and services preparation is in accordance with special standards, for example (including without limitation) to “organic,” “macrobiotic” or allergen-specific standards, for example (including without limitation) “nut-free”, “gluten-free”, or “lactose-free”. However, Welyra is not obligated to provide ingredient information or allergen information on the Platform. Further, Welyra does not guarantee that the Goods sold by Merchants are free of allergens, unless otherwise required by applicable laws. If you have allergies, allergic reactions or dietary restrictions and requirements, please contact the Merchant before placing an Order on our Platform. as Welyra does not independently investigate or verify such representations.
Welyra and the Merchants (as the case may be) reasonably endeavor to comply with your special instructions for an Order. However, in some cases where this is not feasible, possible or commercially reasonable, Welyra and/or the Merchants reserve the right to proceed to prepare the Order in accordance with standard operating procedures. Neither Welyra nor the Merchants shall be responsible to replace or refund an Order which does not conform to special instructions provided by you.
Welyra shall not be liable or responsible for any goods and services offered by Merchants that is unhealthy, is the cause of injury, that is otherwise unacceptable to Users or that does not meet the expectation of Users in any manner.
Users are solely responsible for verifying the accuracy of delivery addresses, and Welyra shall have no liability or responsibility for any such erroneous addresses. All goods and services preparation and deliveries are the sole responsibility of the Merchant accepting the order. Please be aware that the Merchant will do everything they can to meet the delivery time specified, however delivery times may be affected by factors beyond their control and therefore cannot be guaranteed. We will inform you if we become aware of an unexpected delay.
